Oporto Amigurumi is a brand used by its owner and is not a separate company.
By using this website or placing an order, you confirm that you have read and accept these Terms of Service and the other policies available in the shop.
1. Scope of the shop
The Oporto Amigurumi online shop is exclusively intended for sales to private consumers for personal use.
We do not offer wholesale sales, business sales or sales for resale.
Oporto Amigurumi may refuse or cancel orders that, based on the quantity purchased or other objective factors, appear intended for professional activity or resale. In that case, any amounts paid will be refunded in full.
2. Website use
To place an order, customers must be at least 18 years old or have authorisation from their legal representative.
You agree to:
- Provide accurate, complete and up-to-date information;
- Not use third parties' identities, payment details or information without authorisation;
- Not use the website for illegal, fraudulent or unauthorised purposes;
- Not attempt to interfere with the operation, security or availability of the shop;
- Not introduce viruses, malicious code or other elements that could harm the website or its users;
- Not reproduce or commercially exploit shop content without authorisation.
Oporto Amigurumi may restrict or block access to the website where there is objective evidence of fraudulent, illegal or harmful use, without prejudice to users' statutory rights.
3. Products
We aim to present product descriptions, features, photographs, colours, dimensions and other information as accurately as possible.
Colours displayed on screen may vary slightly depending on the device used, monitor settings or lighting conditions.
Amigurumi are handmade. As a result, there may be small variations in shape, size, stitch positioning or finish between pieces of the same design. These are inherent to handmade work and do not, in themselves, constitute a lack of conformity, provided the product matches its advertised essential characteristics.
Unless expressly stated otherwise on the product page, the amigurumi sold are intended for decorative use and are not toys.
Essential use, care, washing and safety information is provided on each product page before purchase. Amigurumi are also supplied with a physical label containing their care and safety instructions. Customers should read, retain and follow this information.
4. Product availability
Displaying a product in the shop does not guarantee its permanent availability.
We aim to keep inventory up to date, but stock discrepancies may occur due to technical errors, incorrect counts, simultaneous sales, damage identified during order preparation or other exceptional circumstances.
If a product becomes unavailable after an order is placed, we will contact the customer as soon as possible. Where applicable, the customer may choose between:
- Replacement with another item;
- Removal of the unavailable item and a refund of its price;
- Cancellation of the order and a full refund.
No substitution will be made without the customer's agreement.
5. Prices and VAT
Prices are shown in euros.
While the owner of Oporto Amigurumi remains covered by the special exemption scheme under Article 53 of the Portuguese VAT Code, VAT will not be charged on sales. Invoices include the applicable statutory wording: “IVA – regime de isenção” (VAT exemption scheme).
Prices shown on product pages do not include shipping charges, which are calculated and displayed separately before the order is completed.
Oporto Amigurumi may change prices at any time. Changes do not affect orders already confirmed, except in the event of an obvious error.
If an obvious error in a product's price or characteristics is detected before dispatch, the customer will be informed and may confirm the order on the correct terms or cancel it and receive a full refund of the amounts paid.
6. Minimum order value
The minimum purchase is €5 in products per order, calculated after discounts and excluding shipping charges.
It will not be possible to complete an order if the value of the products after applicable discounts is below this amount.
7. Placing and confirming an order
Before completing a purchase, customers should check:
- Products and quantities;
- Selected variants;
- Prices and discounts;
- Delivery and billing addresses;
- Email address;
- Telephone number;
- Tax identification number (NIF), if they wish to include it on the invoice;
- Shipping method;
- Total order value.
After completing the purchase, the customer receives an electronic order confirmation.
Confirmation records receipt of the order and does not prevent cancellation in the event of unavailable stock, an obvious error, justified suspicion of fraud, inability to pay or another legitimate reason.
The order is considered accepted after payment is confirmed and the order details are verified.
Oporto Amigurumi may contact the customer if any information needs clarification or correction before shipping preparation.
8. Payment methods
The payment methods actually available are displayed at checkout and may vary depending on the country, device used, order value or payment provider availability.
Customers must follow the instructions and deadlines shown for the selected method.
Order preparation and dispatch will only begin once payment has been confirmed.
If payment is not completed or confirmed within the applicable period, the order may be cancelled automatically.
Oporto Amigurumi does not have access to full card details. Payments are processed by the providers available through Shopify.
9. Promotions and discount codes
Promotions and discount codes are subject to the conditions and deadlines announced for each campaign.
Unless expressly stated otherwise:
- Codes cannot be combined;
- Each code may only be used under the specified conditions;
- Discounts cannot be exchanged for cash;
- Discounts cannot be applied retrospectively to completed orders;
- Misuse, fraud or use contrary to campaign conditions may result in cancellation of the discount or order.
After discounts are applied, the product value must meet the minimum order value set out in these Terms.
10. Shipping and delivery
Orders are shipped only to countries and regions active in the shop at the time of purchase.
Available shipping options, prices and delivery estimates are displayed at checkout and supplemented by the Shipping Policy.
Delivery times shown are estimates and may be affected by circumstances beyond Oporto Amigurumi's control, including carrier delays, busy periods, weather conditions, strikes, operational failures or incorrect or incomplete addresses.
Oporto Amigurumi cannot exclude liability legally attributable to it.
Customers must provide a complete and correct address and ensure someone is available to receive the order where necessary.
Costs of reshipping due to an incorrect or incomplete address, unjustified refusal, repeated absence or failure to collect the order may be charged to the customer, provided the situation does not result from an error by Oporto Amigurumi or the carrier.
The risk of loss or damage passes to the consumer when they, or a person they designate other than the carrier, take physical possession of the goods.
11. Cancellations, returns and refunds
Customers may request cancellation while the order has not yet been processed.
Where legally applicable, consumers have 14 days to exercise their right of withdrawal, calculated in accordance with current law.
Return conditions, related costs, statutory exclusions, item inspections and refund procedures are described in Oporto Amigurumi's Returns and Refund Policy.
Nothing in these Terms limits or excludes consumers' statutory rights.
12. Statutory guarantee and conformity
Products sold benefit from the statutory guarantee of conformity applicable to consumer goods under current Portuguese law.
New movable goods currently benefit from a statutory guarantee period of three years from delivery.
A lack of conformity exists where, among other things, a product does not match the description, quantity, quality, functionality, compatibility or other characteristics agreed upon or reasonably expected by the consumer.
The following do not constitute a lack of conformity:
- Normal wear resulting from regular use;
- Damage caused by improper use;
- Washing or drying contrary to the instructions provided;
- Excessive pulling, cutting, modification or unauthorised repair;
- Damage caused by accidents, improper storage or lack of care;
- Minor variations inherent in handmade production that do not affect the advertised essential characteristics.
These exclusions do not apply where damage results from a pre-existing defect, inadequate instructions or another cause attributable to Oporto Amigurumi.
In the event of a lack of conformity, consumers have the rights provided by applicable law, including, as appropriate, repair, replacement, a proportionate price reduction or termination of the contract.
13. Kits and printed patterns
Oporto Amigurumi kits are sold as single products comprising the components identified on their respective pages.
The printed pattern included in the kit is protected by copyright.
Without Oporto Amigurumi's authorisation, reproduction, scanning, distribution, publication, resale or sharing the pattern with third parties is prohibited, without prejudice to uses permitted by applicable law.
Specific conditions for kit returns and any diminished value of their components are described in the Returns and Refund Policy.
14. Intellectual property
Unless stated otherwise, content available in the shop belongs to Oporto Amigurumi or is used with permission, including:
- The brand name and visual identity;
- Logos;
- Our own photographs;
- Texts and descriptions;
- Illustrations;
- Patterns;
- Manuals and instructions;
- Videos;
- Graphic elements;
- The organisation and presentation of content.
These elements may not be copied, reproduced, modified, distributed, published, resold or commercially exploited without prior permission, except where permitted by law.
Brands, photographs and content belonging to manufacturers, suppliers or other third parties remain the property of their respective owners and are used under the applicable permissions.
15. Third-party links and services
The shop may include links or use services provided by third parties, including payment providers, carriers, order tracking platforms and social networks.
Oporto Amigurumi does not control the content or operation of external websites and is not responsible for third-party acts or omissions not legally attributable to it.
Customers should consult the terms and policies of any external services they choose to use.
16. Liability
Oporto Amigurumi aims to keep the website available, secure and up to date, but does not guarantee uninterrupted operation or freedom from technical faults at all times.
Where permitted by law, Oporto Amigurumi will not be liable for damage resulting from:
- Use of products contrary to the instructions provided;
- Incorrect information entered by the customer;
- Fraudulent or unauthorised use of the customer's account or payment methods;
- Interruptions or failures of third-party services that cannot reasonably be controlled;
- Unforeseeable or unavoidable circumstances beyond its control.
No provision of these Terms excludes or limits liability that cannot legally be excluded, or affects consumers' mandatory rights.
17. Personal data and relationship with Shopify
